What is a request for a residence permit by a young adult?  

A foreign minor in France is exempt from the requirement to have a residence permit. During their minority, they possess a document for the circulation of foreign minors (DCFM). However, to continue to live in France legally upon reaching adulthood, they must have a residence permit.

What are the conditions to be fulfilled for a temporary residence permit application by a young adult?  

Depending on the situation of each minor, the conditions to be fulfilled may differ:

  • When the foreign minor entered France as part of a family reunification process, they may request a temporary residence permit valid for several years or a ten-year permit depending on their residence history (whether it was legal or not) in France and the situation of the initial applicant for family reunification at the time of the residence permit application (whether they hold a ten-year permit or not).
  • When the foreign minor has lived habitually in France since the age of 13 with at least one of their legitimate parents, they may be issued a temporary residence permit for private and family life upon reaching adulthood.
  • When the foreign minor was born in France and can demonstrate having resided in the country for at least 8 uninterrupted years, having completed at least five years of schooling, they may apply for a temporary residence permit for private and family life for a duration of one year.
  • Unaccompanied minors under the care of the ASE may request a temporary residence permit for private and family life for a duration of one year upon reaching adulthood if they can demonstrate a lack of ties to their country of origin, enrollment in a serious and permanent educational program, and confirmation from their hosting institution regarding their integration into French society.
  • Unaccompanied minors under the care of the ASE may request a temporary residence permit for private and family life for a duration of one year upon reaching adulthood if they can demonstrate a lack of ties to their country of origin, enrollment in a serious and permanent educational program, and confirmation from their hosting institution regarding their integration into French society.

What are the grounds for refusal of a residence permit application by a young adult?

  • The prefecture may reject the request for a residence permit by a young adult if one or more of the specific conditions (mentioned above) are not met based on their situation.
  • The inauthentic nature of the requested documents. • If the applicant poses a threat to public order.

How can a rejection of a residence permit application by a young adult be contested?

A challenge against the rejection of a residence permit application by a young adult can be made at two levels: an administrative appeal and/or a legal challenge before the relevant administrative court.
