Enforceability of the employment situation – Foreign Employee

A foreigner who wishes to work in France must have a work authorization in order to be in regular situation. This authorization may be refused if the profession concerned is highly demanded in France and the level of unemployment is too high. The employer who wishes to hire a foreigner in France must verify if the job concerned is on the list of professions in tension.

If this is the case, the employment situation is not enforceable. Otherwise, prior advertising of the job offer for a period of 3 weeks with a public employment service organization (Pôle emploi, APEC, etc.) is required in most cases. The enforceability of the employment situation may be subject to simulation.
